OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards.  a) Jobsite located at 550 Church Road, Avondale, PA 19311, Mushroom House Number 8 -On or about January 27, 2023, employees performed tasks associated with mushroom growing activities such as, but not limited to harvesting mushrooms, watering mushroom beds, and cleaning the mushroom house from the second level of the Mushroom House. Employees performed these tasks from unsecured and movable walking/working surfaces located 17 inches away from the mushroom beds.  Employees were not provided with a means of fall protection exposing employees to falls up to 93 inches to the lower level.   An acceptable means of abatement would be to fully plank and secure the walking/working surfaces and/or ensure that a fall protection system (guard rails, covers, nets or personal fall arrest system) be in place for employees working from elevated walking/working surfaces.
