OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential crushing hazards from falling loads and/or lift parts:  a) Bay 1 (front of shop), 21461 New York 232, Watertown NY, 13601, on or about January 20, 2023, a two-post surface mounted Globe Lift, was operated without being inspected and certified since installation approximately 3 years ago. This lift was being operated with the safety latch bypassed due to mechanical failure in the safety mechanism.  b) Bay 2 (middle of shop), 21461 New York 232, Watertown NY, 13601, on or about February 1, 2023, a two-post surface mounted Forward Lift, SN NHA19F0021, was operated without being inspected and certified since installation approximately 3 years ago.   c) Bay 3 (middle of shop), 21461 New York 232, Watertown NY, 13601, on or about February 1, 2023, a two-post surface mounted Forward Lift, SN NHAI9F0022, was operated without being inspected and certified since installation approximately 3 years ago.  d) Bay 4 (back of shop), 21461 New York 232, Watertown NY, 13601, on or about January 20, 2023, a two-post surface mounted Forward Lift, SN NFY18K0004, was operated without being inspected and certified since installation approximately 3 years ago.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met; specifically:     1) Labeling and other forms of warning;   2) SDS requirements for the hazardous materials known to be present at the jobsite;   3) Employee training and information.  The written program must also include:   (a) A list of all the chemicals used at the jobsite.   (b) Methods to inform employees of hazards associated with non-routine tasks.   (c) Methods the employer will use to inform any contractors employees of workplace hazards.  a) Kidder Automotive, 21461 New York 232, Watertown NY, 13601, on or about February 1, 2023, employees were exposed to hazardous chemicals while engaged in servicing and maintenance activities. The employer did not develop and implement a comprehensive Hazard Communication Program for employees working with hazardous chemicals including, but are not limited to, Clean Brake, compressed oxygen, compressed acetylene, Brake Life, Meta-Seal Brake Squeal Eliminator, and Brake Fluid  Abatement certification is required.

(Electronic access and other alternatives to maintaining paper copies of the safety data sheets are permitted as long as no barriers to immediate employee access in each workplace are created by such options.)  a) Kidder Automotive, 21461 New York 232, Watertown NY, 13601, on or about February 1, 2023, employees were exposed to hazardous chemicals while engaged in servicing and maintenance activities due to the employer not keeping Safety Data Sheets for each hazardous chemical used at the workplace. Hazardous chemicals used at the workplace include, but are not limited to, Clean Brake, compressed oxygen, compressed acetylene, Brake Life, Meta-Seal Brake Squeal Eliminator, and Brake Fluid.  Abatement certification is required.
