29 CFR 1910.178(a)(5): The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered: The employer is failing to protect employees from struck-by hazards. This was most recently documented on or about February 1, 2023, at the BCS Stone Showroom facility located at 12900 I Street, Omaha, Nebraska. The employer is using an aftermarket front-end attachments on both a Caterpillar Forklift model EC15: S/N - 3FM00911 and Yale Forklift Model GLC120MGNGBE085: S/N - B818N01678X when raising stone flabs. The forklifts do not have updated plates or markings to identify the change in weight capacity that such attachments cause.

This was most recently documented on or about February 1, 2023, at the BCS Stone Showroom facility located at 12900 I Street, Omaha, Nebraska. The employer is using a forklift with a front-end attachment on loads that are over the weight capacity of the Caterpillar Forklift model EC15: S/N - 3FM00911. Employees are lifting stone slabs with a long-arm attachment on slabs weighing 700 - 800lbs with a forklift rated to be lifting only 709lbs.

29 CFR 1910.178(q)(6):Industrial trucks shall not be altered so that the relative positions of the various parts are different from what they were when originally received from the manufacturer, nor shall they be altered either by the addition of extra parts not provided by the manufacturer or by the elimination of any parts, except as provided in paragraph (q)(12) of this section. Additional counterweighting of fork trucks shall not be done unless approved by the truck manufacturer. The employer is failing to protect employees from the potential struck-by hazards in the following but not limited to. This was most recently documented on or about February 1, 2023, at the BCS Stone Showroom facility located at 12900 I Street, Omaha, Nebraska. A) Additional counterweighting in the form of stone-slabs are being attached to the back of the of fork trucks were done the Caterpillar Forklift model EC15: S/N - 3FM00911 without approval by from the truck manufacturer. B) Additional counterweighting in the form of stone-slabs are being attached to the back of the Yale Forklift Model GLC120MGNGBE085: S/N - B818N01678X without approval from the manufacturer.
