29 CFR  1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:  (a)Aldrin Gomez at 5300 South Marion Road, Sioux Falls, SD 57108: On or about and at times prior to January 26, 2023, the employer did not ensure frequent and regular inspections were conducted of the jobsite. Employees were conducting roofing operations on a residential property without the use of fall protection while on the roof and working from a mobile platform.  Employees were also exposed to ladder hazards and lack of training. This condition exposed employees to various hazards while working on the site.

This condition exposed employees to falls greater than six feet.

29 CFR  1926.1053(b)(13): The top or top step of a stepladder was used as a step:  (a)Aldrin Gomez at 5300 South Marion Road, Sioux Falls, SD 57108: On or about and at times prior to January 26, 2023, the employer did not ensure that employees were not utilizing the top step of a portable A-frame ladder being used on the site to conduct residential framing activities.   This condition exposed employees to fall hazards of approximately 10 feet.
