(a) At the worksite: On or about 2/2/2023, employees were using hand and battery powered tools without eye protection while installing concrete forms, exposing them to struck-by type injuries from flying debris.

(a) At the worksite: On or about 2/2/2023, employees utilized a damaged portable extension ladder, that was not withdrawn from service, to access a wall bracket scaffold.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. (a) At the worksite: On or about 2/2/2023, employees were exposed to fall hazards while utilizing an unguarded access plank, without fall protection, at a height of approximately 6 feet 9 inches above the lower level. A&E Construction Co. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.501(b)(10), which was contained in OSHA inspection number 1423295, citation number 01, item number 001 and was affirmed as a final order on 03/03/2020, with respect to a workplace located at Marlton Crossing Shopping Center, 101 NJ 73 South, Marlton, NJ 08053.
