OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the struck-by or crushing hazards when operating a forklift without the use of a restraint device: (a) Yard and Storage area: On or about January 31, 2023, and at time prior to, the employer did not furnish a seatbelt for employees to wear while operating the Pettibone 8042; SN: 2788143[6-977] rough terrain forklift or the Ingersoll Rand VR-642B; SN: 172628 rough terrain forklift. (b) Yard and Storage area: On or about January 31, 2023, and at time prior to, the employer did not require forklift operators to wear the seatbelt while operating the GEHL RS6-34; SN RS634DJ23126 or the Toyota 42 6F GU25; SN: 66906 forklift. Note: Abatement certification IS required for this item.

Employees use forklifts to move logs and sawn lumber. NOTE: Abatement certification IS required for this item.
