29 CFR  1910.37(a)(3):Exit routes must be free and unobstructed. No materials or equipment may be placed, either permanently or temporarily, within the exit route. The exit access must not go through a room that can be locked, such as a bathroom, to reach an exit or exit discharge, nor may it lead into a dead-end corridor. Stairs or a ramp must be provided where the exit route is not substantially level.  a) On or about February 2, 2023, the rear exit outside discharge was not kept free and unobstructed in that the discharge area was surrounded by multiple vending machines, the garbage compactor, garbage, and a metal grill  preventing employees from exiting the building.

29 CFR  1910.178(l)(2)(ii):Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  a) On or about February 2, 2023, the employer did not ensure that employees were given training that included formal instruction when operating the motor driven pallet jacks such as but not limited to the Jungheinreich electric pallet jack model EJE120 SN 98060113 and the Mitsubishi Forklift Model FB18KT SN EFB5B00385, exposing employees to struck by hazards.

29 CFR  1910.178(l)(6): Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation.   a) On or about February 2, 2023, the employer did not certify that each employee operating an electric pallet jack and forklift  had been provided  training that included formal instruction, driving instruction, and an evaluation when operating the motor driven pallet jacks such as but not limited to the Jungheinreich electric pallet jack model EJE120 SN 98060113 and the Mitsubishi Forklift Model FB18KT SN EFB5B00385, exposing employees to struck by hazards.
