29 CFR  1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program that included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):  34 Dale Road, suite 106:   On or about January 30, 2023, the employer did not include a list of the hazardous chemicals known to be present in the workplace, or the methods they will use to inform employees of the hazards of non-routine tasks in their work areas, within the written hazard communication program generated when employees were exposed to hazardous chemicals. Pinalen Floral delight cleaning solution containing lauric acid, a Category 3 skin irritant and Category 2B eye irritant, and Clean by Peroxy cleaning solution containing hydrogen peroxide a Category 2 skin and eye irritant, were among the products stored and used in the workplace.

29 CFR  1910.1200(g)(8):  The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work area(s).  34 Dale Road, suite 106:   On or about January 30, 2023, the employer did not maintain in the workplace copies of the required safety data sheets (SDS')for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work area(s) when employees were exposed to hazardous chemicals. This included SDS' for products stored and used in the workplace such as a Pinalen Floral delight cleaning solution containing lauric acid, a Category 3 skin irritant and Category 2B eye irritant, and a Clean by Peroxy cleaning solution containing hydrogen peroxide a Category 2 skin and eye irritant, were among the products stored and used in the workplace.

29 CFR  1910.1200(h)(1):Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  34 Dale Road, suite 106:   On or about January 30, 2023, the employer failed to provide employees with effective information and training on the hazardous chemicals that were stored in their work area when they were exposed to the chemical ingredients of the cleaning products that were used in the office. These products included, but were not limited to, a Category 3 skin irritant and Category 2B eye irritant cleaning solution containing lauric acid called Pinalen Floral delight and a Category 2 skin and eye irritant cleaning solution containing hydrogen peroxide called Clean by Peroxy.
