On or about January 26, 2023 and thereafter, at an establishment located at 2099 Badgerland Drive, in Green Bay, Wisconsin; employees performing activities under the control of hazardous energy did not have a periodic inspection conducted at least annually to ensure the steps in the energy control procedure are being followed and the employees involved knew their responsibilities under the procedure exposing employees to inadvertent/accidental restart of equipment.

Prior to starting work on machines or equipment that have been locked out or tagged out, the authorized employee shall verify that isolation and deenergization of the machine or equipment have been accomplished. On or about January 26, 2023 and thereafter, at an establishment located at 2099 Badgerland Drive, in Green Bay, Wisconsin at the Receiving Pit C and D; prior to work performed on the trough/liner of the Receiving Pit C and D inclined screw auger verification of proper de-energization was not accomplished exposing employees to potential caught in hazards.

29 CFR 1910.146(d)(5)(i): Test conditions in the permit space to determine if acceptable entry conditions exist before entry is authorized to begin, except that, if isolation of the space is infeasible because the space is large or is part of a continuous system (such as a sewer), pre-entry testing shall be performed to the extent feasible before entry is authorized and, if entry is authorized, entry conditions shall be continuously monitored in the areas where authorized entrants are working; On or about February 1, 2023, at an establishment located at 2099 Badgerland Drive, in Green Bay, Wisconsin at the Receiving Pit C and D; the employer did not ensure the permit space was tested prior to entry into the inclined trough area and receiving pits to perform removal, installation, and welding activities for the trough / lining exposing employees to asphyxiations hazards.
