OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the struck-by or crushing hazards when operating a forklift without the use of a restraint device:   (a) On or about February  2, 2023 and at times prior thereto; the employer did not ensure seatbelts were available for employees operating the Toyota Model 42-6FG25, S/N 14362.  (b) On or about February  2, 2023 and at times prior thereto; the employer did not ensure seatbelts were available for employees operating the Toyota Model 52-6FGU35, S/N 60895. 29 CFR  1910.151(c):Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:  (a) On February 2, 2023 and at times prior, employees exposed to corrosive materials such as but not limited to Prime Guard Power Blast Windshield Wash, were not provided with an eyewash station  within the immediate work area. 29 CFR  1910.178(a)(4):Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:  (a)On or about February  2, 2023 and at times prior thereto; the employer did not protect employees from injury in that employees were operating a Toyota model 42-6FGU25, s/n 69550, forklift that had it forks modified with a hole drilled to accommodate a 2 inch ball. This modification had not been approved by the forklift manufacturer.  Abatement Note: Abatement certification is required for this item.
