OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from entrapment or struck-by  hazards:   a) East Dock Area; 1065 Poplar Street, Johnstown, CO 80534: On or about 02/02/2023, seatbelts were not utilized by employees when operating equipment such as, but not limited to, a  Hyster 60 Sit- Down Propane Fork Lift (Model # H60XL, S/N #C177B07975M). Employees working in the Transportation department were potentially exposed to stuck-by and/or crushing hazards from tip-overs and/or ejection.

29 CFR  1910.37(a)(3):Exit route(s) were not kept free and unobstructed:   a) Production Area - Back Emergency Exit Door - On or about 02/02/2023, employees who worked in the production and storage areas of the facility were potentially exposed to fire hazards in that, wooden pallets, boxes of plastic pellets, cardboard boxes, and material to be recycled, blocked an exit door.

29 CFR 1910.212(a)(3)(ii): Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s):  a) Warehouse:  On 02/02/2023, the employer exposed employees to amputation hazards in that equipment including, but not limited to, a vertical band saw was not adequately guarded.  The vertical band saw had an exposed blade of approximately 12 inches to cut buckets. The buckets had been cut approximately two (2) weeks prior.

29 CFR  1910.304(f)(1)(iv): Overcurrent devices for circuits rated 600 volts, nominal, or less, were not readily accessible to each employee or authorized building management personnel:   a) Warehouse, Untha Shredder Machine Area:  On 02/02/2023, the employer exposed employees to potential shock and/or fire hazards, in that a homemade crane was placed approximately 24" or less in front of a bank of 480 volts electrical shut-off (On/Off) switches. This blocked access to the electrical shut-offs used to power the Untha Shredder machine, Bailer 2, etc.  b) Warehouse, NGR Area:  On 02/02/2023, the employer exposed employees to potential shock and/or fire hazards, in that bags of plastic and other plastic materials were placed in front of an 480 volt electrical shut-off and an electrical panel. This blocked access to the electrical shut-off and electrical panel used to power the NGR machine.  c) Warehouse, near Pulverizer Area: On 02/02/2023, the employer exposed employees to potential shock and/or fire hazards, in that of old equipment on a wooden pallet and a hydraulic jack were placed approximately 26" or less in front of an electrical panel. This blocked access to the electrical panel used to power heaters and a bailer.
