29 CFR  1926.502(d): "Personal fall arrest systems." Personal fall arrest systems and their use shall comply with the provisions set forth below. Effective January 1, 1998, body belts are not acceptable as part of a personal fall arrest system. Note: The use of a body belt in a positioning device system is acceptable and is regulated under paragraph (e) of this section.   a. Manuel Pinto Construction located at 5783 Inlet Point Ln,  Lot 42, Westerville, OH 43081: On  or about February 3, 2023,  the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employees conducted framing activities without compliant fall protection/prevention system, thereby exposing them to fall hazards of over 10 feet.

29 CFR  1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment shall be independent of any anchorage being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee attached, or shall be designed, installed, and used as follows:   a. Manuel Pinto Construction located at 5783 Inlet Point Ln, Lot 42, Westerville, OH 43081: On or about February 3, 2023, the employer did not ensure that employees were protected from falls with compliant anchorages while performing framing work on the roof of a residential home. Pass through anchor devices were secured to single 2x4 trusses and in close proximity to the nail plates. The following condition resulted non-compliant anchorages being used and exposed employees to fall hazards of over 10 feet.

29 CFR  1926.502(d)(16): Personal fall arrest systems, when stopping a fall, shall:   29 CFR  1926.502(d)(16)(iii): be rigged such that an employee can neither free fall more than 6 feet (1.8 m), nor contact any lower level;  a. Manuel Pinto Construction located at 5783 Inlet Point Ln,  Lot 42, Westerville, OH 43081: On  or about February 3, 2023,  the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employees were framing the roof with lifelines that were not adjusted to prevent a free fall to less than 6 feet nor contact with the ground below, the following condition exposed employees to fall hazards of over 10 feet.

29 CFR  1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.   a. Manuel Pinto Construction located at 5783 Inlet Point Ln,  Lot 42, Westerville, OH 43081: On or about February 3, 2023, the employer did not provide a training program for each employee exposed to fall hazards to ensure each employee recognized the hazards of falling and the procedures to be followed in order to minimize these hazards. Framers were  on a 10/12 pitch roof that varied from 10-22 feet. The framers were wearing safety harnesses with pass through anchor points in close proximity to the nail plates and lifelines that would not have prevented a fall with in six feet nor making contact with a lower surface. The employees were not utilizing compliant fall protection which exposed them to falls over 10 feet.
