29 CFR 1910.22(a)(3): Walking-working surfaces are maintained free of hazards such as sharp or protruding objects, loose boards, corrosion, leaks, spills, snow, and ice. At a worksite located at 950 Metrecal Trace, Cabool, Missouri. Employees in the South Dock area were exposed to serious injuries in that slip, trip and fall hazards were created by the snow and ice accumulating on the walking working surface of the milk tankers. Employees are required to access tankers to test milk when they arrive and clean tankers before they depart the facilities.

29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: guardrail systems; safety net systems; or personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems. At a worksite located at 950 Metrecal Trace, Cabool, Missouri. Employees in the South Dock area were exposed to a fall hazard of approximately 10 feet when accessing tankers using the safe rack stair system with cage. The cage is mobile and is attached to a fixed ladder system. The cage is lowered onto the walking working surface of the tanker and is used as fall protection. Tankers vary in size and design. The cage does not provide uniformed fall protection for every tanker that employee's process.

The certification should identify the machine or equipment on which the energy control procedure was being utilized, the date of the inspection, the employees included in the inspection, and the person performing the inspection. (a) In that an examination of program elements determined that periodic inspections of energy control procedures were not accomplished and certified. Specifically, reviews were not conducted to determine if listed steps were still adequate, if any changes had occurred, or if employees had acquired the knowledge needed to effectively isolate energy sources.
