29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program the following provisions of this section, as applicable: a) Hawk Construction, 354 S Williams St, Denver, CO: On or about February 6, 2023, and at times prior, employees were exposed to respiratory hazards while working with cement and drywall. The employer did not provide medical evaluations to employees required to use the respirators as required in 1910.134(c)(1)(ii). b) Hawk Construction, 354 S Williams St, Denver, CO: On or about February 6, 2023, and at times prior, employees were exposed to respiratory hazards while working with cement and drywall. The employer did not provide fit testing procedures for tight-fitting respirators to employees required to use the respirators as required in 1910.134(c)(1)(iii). c) Hawk Construction, 354 S Williams St, Denver, CO: On or about February 6, 2023, and at times prior, employees were exposed to respiratory hazards while working with cement and drywall. The employer did not provide procedures for proper use of respirators in routine and reasonably foreseeable emergency situations for tight-fitting respirators to employees required to use the respirators as required in 1910.134(c)(1)(iv). d) Hawk Construction, 354 S Williams St, Denver, CO: On or about February 6, 2023, and at times prior, employees were exposed to respiratory hazards while working with cement and drywall. The employer did not provide procedures for cleaning, disinfecting, storing, inspecting, repairing, discarding, and otherwise maintaining respirators of employees required to use the respirators as required in 1910.134(c)(1)(v). e) Hawk Construction, 354 S Williams St, Denver, CO: On or about February 6, 2023, and at times prior, employees were exposed to respiratory hazards while working with cement and drywall. The employer did not provide training of employees in the respiratory hazards to which they are potentially exposed during routine and emergency situations for employees required to use the respirators as required in 1910.134(c)(1)(vii). f) Hawk Construction, 354 S Williams St, Denver, CO: On or about February 6, 2023, and at times prior, employees were exposed to respiratory hazards while working with cement and drywall. The employer did not provide training on putting on, removing, or the limitations of the respirators for employees required to use the respirators as required in 1910.134(c)(1)(viii). g) Hawk Construction, 354 S Williams St, Denver, CO: On or about February 6, 2023, and at times prior, employees were exposed to respiratory hazards while working with cement and drywall. The employer did not establish work-site specific procedures to regularly evaluate the effectiveness of the program as required in 1910.134(c)(1)(ix).

29 CFR 1910.132(d)(1):The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). a) Hawk Construction, 354 S Williams St, Denver, CO: On or about February 6, 2023, and at times prior, employees were exposed to respiratory hazards as a result of an improper job hazard and PPE assessment. The employer has not established what tasks require personal protective equipment and how to properly utilize the equipment to provide safe work conditions for employees.
