29 CFR 1926.454(a)(3): Scaffolds. Training requirements. This section supplements and clarifies the requirements of 1926.21(b)(2) as these relate to the hazards of work on scaffolds. The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable: The proper use of the scaffold, and the proper handling of materials on the scaffold. a) On or about January 30, 2023, the employer did not ensure that every employee operating the up-stage static line bracket platform received specific training for the proper use of this particular scaffold system utilized at the Bethesda North Hospital jobsite; in that one of the operators was not aware of how to stop the motor using the pendant control, causing the scaffold to tilt and to descend four floors in an uncontrol manner.

29 CFR 1926.502(d)(20): Fall Protection. Fall protection systems criteria and practices. Personal fall arrest systems. The employer shall provide for prompt rescue of employees in the event of a fall or shall assure that employees are able to rescue themselves. a) On or about January 30, 2023, the employer did not ensure that while two employees were working from and descending from a suspended scaffold system, there was no rescue plan established by the employer in case of a fall, accident or incident.
