29 CFR  1926.651(c)(2):  Means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees.  a. Located at the vicinity of 840 West State Street, Columbus, Ohio:  On or about February 02, 2023, three employees worked in a trench with a depth greater than nine feet without a means of egress maintained in the trench while performing a new sanitary line install.  Boss Excavating & Grading was previously cited for a serious violation of this Occupational Safety and Health standard 29 CRF 1926.651(c)(2), which was contained in OSHA inspection number 1446106, citation number 1, item number 1 and was affirmed as a final order on December 17, 2019 with respect to a workplace located at 9341 Jerome Road in Dublin, Ohio 43017.

29 CFR  1926.651(k)(1):  Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated.  a.  Located at the vicinity of 840 West State Street, Columbus, Ohio: On or about February 02, 2023, the employer did not ensure that a competent person inspected the trench onsite to ensure that a protective system was in place in all areas of the trench where employees performed sanitary line installation work. A competent person did not instruct employees of unsafe conditions when work was performed outside of a shielding box in place exposing employees to cave-in hazards.  b.  Located at the vicinity of 840 West State Street, Columbus, Ohio: On or about February 06, 2023, the employer did not ensure that a competent person inspected the trench onsite to ensure that a protective system was in place in all areas of the trench where employees performed sanitary line installation work. 29 CFR  1926.652(a)(1):  Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when:  a. Located at the vicinity of 840 West State Street, Columbus, Ohio:  On or about February 02, 2023, employees were working in a trench at depths greater than nine feet while performing a new sanitary line installation.  Employees performed work in the unprotected area of the trench adjacent the trench shield in place, thereby exposed to crushed-by hazards.  b. Located at the vicinity of 840 West State Street, Columbus, Ohio:  On or about February 06, 2023, an employee was working in a trench at depths greater than nine feet while performing a new sanitary line installation.  The employee performed work in the unprotected area of the trench adjacent the trench shield in place, thereby exposed to crushed-by hazards.  Boss Excavating & Grading was previously cited for a serious violation of this Occupational Safety and Health standard 29 CRF 1926.652(a)(1), which was contained in OSHA inspection number 1446106, citation number 1, item number 2b and was affirmed as a final order on December 17, 2019 with respect to a workplace located at 9341 Jerome Road in Dublin, Ohio 43017.
