(iii) Safety and health considerations: (c) Control measures to be taken if physical contact or airborne exposure occurs; (a) On or about January 31, 2023, the employer did not developed an adequate written operating procedures for the nitric acid production process that provided clear instructions on how to conduct air monitoring during line breaking to protect employees who should respond to the potential hazard of being exposed to a "red gas" release while the employees were conducting line breaks in the nitric acid plant during the 90 day shut downs for maintenance.

29 CFR 1910.119(f)(4): The employer shall develop and implement safe work practices to provide for the control of hazards during operations such as lockout/tagout; confined space entry; opening process equipment or piping; and control over entrance into a facility by maintenance, contractor, laboratory, or other support personnel. These safe work practices shall apply to employees and contractor employees. (a) On or about January 31, 2023, the employer had not developed and implemented written operating procedures that provided clear instructions on how employees and contractors should respond if they were exposed to a "red gas" (nitric oxides, nitrogen dioxide, or NOx) release while conducting line breaks in the nitric acid plant during a shut down.

29 CFR 1910.1000(a)(1): Substances with limits preceded by "C" - Ceiling Values. An employee's exposure to any substance in Table Z-1, the exposure limit of which is preceded by a "C", shall at no time exceed the exposure limit given for that substance. If instantaneous monitoring is not feasible, then the ceiling shall be assessed as a 15-minute time weighted average exposure which shall not be exceeded at any time during the working day. (a) On or about January 31, 2023, the employer did not conduct air monitoring for nitrogen dioxide while employees were performing a line break in the nitric acid plant to change the gauze and getter in the converter and were exposed to a "red gas" (nitric oxides or NOx) release while the employees were loosening the bolts on the top of the converter cone.
