1910.9(b) Training. Standards in this part requiring training on hazards and related matters, such as standards requiring that employees receive training or that the employer train employees, provide training to employees, or institute or implement a training program, impose a separate compliance duty with respect to each employee covered by the requirement. The employer must train each affected employee in the manner required by the standard, and each failure to train an employee may be considered a separate violation.  (a)On or about January 31, 2023, the employer did not ensure that employees were properly trained on the employer?s policy and  procedures in regard to the operation of the Speed-Pak baler in that an employee?s hand was injured by the motion of the hooks on the platen through the ejection chain hangar while resetting the chain eject system on the back side of the vertical baler.   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.
