29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor was employee provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) Jobsite located at 124 E Indiana Ave, Philadelphia, PA 19134: On or about February 7, 2023, the employer did not ensure each employee engaged in residential construction activities 6 feet or more above lower levels was protected by guardrail systems, safety net system, personal fall arrest system, or an alternative fall protection measure. Employees were required to access the roof without fall protection to conduct activities below the communication tower, thereby exposing employees to fall hazards.

29 CFR 1926.1051(a):Stairways or ladders were not provided at all personnel points of access where there was a break in elevation of 19 inches or more, and no ramp, runway, sloped embankment, or personnel hoist was provided: a) Jobsite located at 124 E Indiana Ave, Philadelphia, PA 19134: On or about February 7, 2023, the employer did not ensure stairways or ladders were provided at all personnel points of access where there was a break in elevation of 19 inches or more, and no ramp, runway, sloped embankment, or personnel hoist was provided. Employees used a doorway with approximately 3 feet distance to roof level to access the roof and conduct work activities below the communication tower, thereby exposing employees to fall hazards.
