29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. On February 7, 2023, and times prior thereto, at a work site located at 400 Hazelwood Dr., Fort Worth, Texas, daily inspections were not performed of a vertical excavated wall approximately 10.5 feet in depth and adjacent to a residential home, air conditioning units, an existing stone wall, iron fencing and other underground utilities. The vertical wall was unprotected and employees were exposed to struck-by and engulfment hazards while installing a concrete foundation and wall within 2 feet. The vertical wall and fencing collapsed into the work area.

29 CFR 1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On February 7, 2023, and times prior thereto, at a work site located at 400 Hazelwood Dr., Fort Worth, Texas, employees building a concrete wall worked immediately next to an unprotected excavated wall that was approximately 10.5 feet in depth and 35ft long, with an adjacent residential home, utilities, fencing and a retaining wall with backfill pre-disturbed soil above. Employees installed a 35ft long x 10.5 feet high concrete/brick wall within two (2) feet of the unprotected excavated wall and were exposed to struck by and cave-in hazards.
