OSH ACT of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to combustible wood dust explosion, deflagration, and fire hazards while working near an indoor rotary dryer and cyclone system that was located, installed, and operated in a manner that exposed employees to combustible dust hazards: (a) Dryer Building; On or about January 31, 2023, the employer operated an indoor rotary dryer and cyclone system in a manner that exposed employees to combustible wood dust explosion, deflagration, and fire hazards. The indoor rotary dryer was located indoors and not isolated from work areas. The indoor cyclone was located indoors and did not contain means of explosion protection, deflagration propagation protection, and fire protection.

Pre-entry air monitoring was not conducted, periodic air monitoring was not conducted, energy sources (electrical, thermal) were not isolated and locked out, entry permits were not completed, procedures were not developed for summoning rescue services, rescue and emergency equipment was not used, and an authorized attendant was not present outside the confined spaces during entry.
