29 CFR 1910.22(a)(1):  The employer did not ensure that all places of employment, passageways, storerooms, service rooms, and walking-working surfaces are kept in a clean, orderly, and sanitary condition:  (a) Throughout the dryer building; On or about January 31, 2023, the employer did not ensure that walking-working surfaces around and beneath the drying drum were kept clean to prevent accumulations of combustible wood dust.  Accumulated sawdust on the floor around the dryer drum started on fire.

29 CFR 1910.146(c)(4):  When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146:  (a) Throughout the facility; On or about January 31, 2023, a permit required space entry program was not implemented prior to allowing employees to enter confined spaces, such as the dryer drum.  Pre-entry air monitoring was not conducted, periodic air monitoring was not conducted, energy sources (electrical, thermal) were not isolated and locked out, entry permits were not completed, procedures were not developed for summoning rescue services, rescue and emergency equipment was not used, and an authorized attendant was not present outside the confined spaces during entry.

29 CFR 1910.146(g)(1):  The employer did not provide training so that all employees whose work was regulated by 29 CFR 1910.146 (permit required confined spaces) acquired the understanding, knowledge, and skills necessary for the safe performance of the duties assigned under 29 CFR 1910.146:   (a) Throughout the facility; On or about January 31, 2023, confined space entry training was not provided to inform employees of the hazards within each confined space, entrant requirements, attendant requirements, atmospheric monitoring requirements, rescue procedures, and how to contact emergency services for areas prior to entry of confined spaces, such as the dryer drum.
