29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: On or about February 8, 2023, and times prior to, on the front second level leading edge of a residential dwelling, the employer failed to ensure instruction was provided to employees in recognizing and avoiding unsafe working conditions prior to working at heights greater than 6 feet, exposing employees to fall hazards.

29 CFR 1926.501(b)(1):Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: On or about February 8, 2023, and at times prior to, on the front second level leading edge of a residential dwelling under construction, an employee was exposed to a fall hazard of greater than 6 feet.

29 CFR 1926.1053(b)(1):Because of the portable ladder's length, the ladder side rails did not extend to at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access and the ladder was not secured at its top to a roof landing. On or about February 8, 2023, and at times prior to, the ladder used to access the second floor did not extend at least three feet above the eave or roof line where employees were working. This conditions exposed workers to fall hazard of greater than 6 feet.
