29 CFR 1910.252(a)(2)(xiii)(C):The employer will have more oversight on the equipment and process being used to perform the welding activities in the Hot Oil Room when appropriate. : On or about February 6, 2023, the employer failed to ensure that the equipment and process being used to perform the welding activities in the Hot Oil Room was appropriate. Stick welding was being used with no fire prevention steps in place to allow for the safe control of the sparks being created. These sparks ultimately led to a fire being started in the room during the welding activities.

29 CFR 1910.252(a)(2)(xiii)(D): The employer did not recognize its responsibility for the safe usage of cutting or welding equipment, and did not advise all contractors about flammable materials or hazardous conditions of which they may not be aware: On or about February 6, 2023, the employer failed to ensure that the sub-contractors who were set to perform welding activities in this hot oil room were informed of the materials being stored in the room as well as any accumulations of oil and debris on the walls and pipes for which all could be considered flammable materials. During the stick welding process, sparks came into contact with the accumulations of flammable material on the pipe being welded and thus led to a fire being started in the room during the welding activities.
