29 CFR 1910.178(a)(4): Modifications and additions which affect the capacity and safe operation of the powered industrial trucks were performed by the employer without the manufacturer's prior written approval. On or about February 9, 2023, and at times prior thereto, employees were utilizing a tilt truck and platform without the approval of the forklift manufacturer, exposing the employees to a struck-by hazard. Instance 1) A job-made pallet-mounted tilt truck was used to move the trash to onsite dumpsters. Instance 2) A U-Line forklift aerial platform was used to lift personnel within the warehouse.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s). On or about February 9, 2023, and at times prior thereto, employees were utilizing a Toyota Forklift without a working seat belt and a fire extinguisher, exposing employees to various hazards as an operator and while working near other employees.
