Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to caught in hazards during camshaft sanding/polishing. On or about February 8, 2023, employees were operating QPAC #266 and #270 engine lathes to sand and polish the rotating camshafts. Employees were exposed to caught-in hazards likely to result in serious injuries due to entanglement of their extremities, clothing, or hair, on the irregular periphery of the camshaft (i.e. holes, keys, lobes). A pinch point also existed where the handheld sand paper could get pulled and wrapped around itself on the rotating camshaft.

29 CFR 1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye. On or about February 8, 2023, the employer failed to timely report, the hospitalization of an employee who sustained a multiple fracture to the left arm when the arm became entangled in a lathe during hand polishing activities. The employee was hospitalized on the date of injury on January 4, 2023.

29 CFR 1910.212(a)(1):One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: On or about February 8, 2023, the employer failed to ensure that the QPAC #266 and #270 lathes had chuck guards in place to protect employees from the rotation of the chuck during polishing operations.
