29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) At Token Chase, Lot #169, Empire Heirloom Subdivision, Cumming, GA 30040; On or about January 28, 2023, and at times prior, the employer exposed employees to caught in and struck by hazards, in that the employees were engaged on the ground directional boring for the installation of main optic fiber for a housing subdivision. The employer failed to provide appropriate training in the recognition of hazards while laying high-density polyethylene (HDPE) conduit pipe inside a 24-inch-deep ditch.

29 CFR 1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye. a) At Token Chase, Lot #169, Empire Heirloom Subdivision, Cumming, GA 30040; On or about January 28, 2023, an employee was injured when pulling a high-density polyethylene (HDPE) conduit pipe inside a 24 inch deep ditch suffered injuries to the right leg when the employee's foot was caught by a bull-line and pulled onto the borer. The employer failed to report the work-related hospitalization within 24-hours to OSHA.
