OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to impact and/or fall from motorized pallet jack hazards due to dock plates extended beyond the surface of the trailer. On February 7, 2023, the employer failed to ensure that inspections were performed with appropriate frequency to identify damaged vehicle components and/or uneven surfaces on the loading dock plate that could expose employees operating Crown PE4500 motorized pallet jack to hazards associated with being ejected from the vehicle while in motion. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records. Among other methods, feasible and acceptable means of abatement would include, but not limited to the following: 1. Complete a Daily PIT Inspection Checklist for the purposes of identifying issues with the assigned Crown Pallet Jack; 2. Conduct and document regular inspections of the Loading Dock to ensure there are no uneven surfaces that could damage the pallet jack or result in serious injury to the employee. 3. Conduct and document monthly dock plate inspections in accordance with the dock plate manufacturer?s instructions to ensure the appropriate leveling of the dock plates used for and unloading trailers.

The employer must ensure: (1) Walking-working surfaces are inspected, regularly and as necessary, and maintained in a safe condition; a) On or before February 7, 2023, the employer did not ensure walking-working surfaces such as the dock plates located on the delivery outbound docks including Dock 29, 30, 31, 32, 33, and 34 were inspected, corrected and repaired before employees were required to use the dock doors with a gap between the dock plates and the trailer to load and unload trucks.

The employer must ensure: (2) Hazardous conditions on walking-working surfaces are corrected or repaired before an employee uses the walking-working surface again. If the correction or repair cannot be made immediately, the hazard must be guarded to prevent employees from using the walking-working surface until the hazard is corrected or repaired; and a) On or before February 7, 2023, the employer did not ensure walking-working surfaces such as the dock plates located on the delivery outbound docks including Docks 29, 30, 31, 32, 33, and 34 were corrected and repaired before employees were required to use the dock doors again. These dock doors still maintained a gap between the dock plates and the trailer during the loading of trucks while using motorized pallet jacks.

29 CFR 1910.176(a): Use of mechanical equipment. Where mechanical handling equipment is used, sufficient safe clearances shall be allowed for aisles, at loading docks, through doorways and wherever turns or passage must be made. Aisles and passageways shall be kept clear and in good repair, with no obstruction across or in aisles that could create a hazard. Permanent aisles and passageways shall be appropriately marked. a) On or about February 7, 2023, the employer did not ensure that during the use of mechanical equipment such as the Crown PE4500 motorized pallet jacks that sufficient safe clearance at loading docks including Docks 29, 30, 31, 32, 33, and 34 was present to ensure that employees were not exposed to hazards such as being ejected from the pallet jack due to the gap between the dock plate and the trailer as employees were backing out of the trailer.

Truck-related topics: (G) Fork and attachment adaptation, operation, and use limitations; (H) Vehicle capacity; (I) Vehicle stability; a) On or about June 14, 2023, the employer did not ensure that motorized pallet jack operators were adequately trained to understand the use limitations of loading 90 inch forks with 3 full metal carts at the same time. The operators did not adequately understand the vehicle's capacities and how to equally distribute the weight for 3 full metal carts with different weights per cart. First cart weighed 548 pounds, the middle cart weighed 1011 pounds and the cart farthest from the operator weighed 1025 pounds.

Caution shall be exercised when handling off-center loads which cannot be centered. a) On or June 14, 2023, the employer did not ensure that by lifting 3 full carts onto 90 inch forks for the motorized pallet jacks that caution was exercised when handling off-centered loads over 2000 pounds including delivery number 5010 where the first cart weighed 548 pounds, the middle cart weighed 1011 pounds and the cart farthest from the operator weighed 1025 pounds located on motorized pallet jack observed.
