OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees due to unsafe work practices associated with tree removal work using a Bobcat S650 Skid Steer.   a) Side yard of home: On or about February 10, 2023, an employee was exposed to fall hazards when he was raised up to access the roof of the home on the elevated grappler attachment of the Bobcat S650 Skid Steer which exposed the employee to a fall hazard of approximately 11 feet.

29 CFR  1910.28(b)(1)(i):  Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  a) Roof of Home: On or about February 10, 2023, an employee working on the roof of a home with a fall distance of 11 feet to the ground below was exposed to fall hazards when the employer did not ensure that he used an acceptable form of fall protection described in this standard.
