29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: On or about February 9, 2023, prior and after employee(s) were exposed to respiratory stressors associated with being allowed to voluntarily wear Miller Half Mask Respirators with filters. The employee(s) were not medically evaluated to determine the employee's ability to use a respirator. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.134(k)(6):The basic advisory information on respirators, as presented in Appendix D of this section, shall be provided by the employer in any written or oral format, to employees who wear respirators when such use is not required by this section or by the employer. On or about February 9, 2023, prior to and after employee(s) were exposed to respiratory stressors associated with being allowed to voluntarily wear a Miller Half Mask Respirator with filters. The employee(s) had not been provided with the Appendix D before wearing the tight fitting respirator. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
