29 CFR  1903.19(d)(1):The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required. 29 CFR  1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  On or about February 10, 2023, the employer did not ensure that employees engaged in residential construction activities were protected from fall hazards.   Employees Framing a second level of a new construction dwelling and were not utilizing fall protection, exposing them to falls of approximately 12 to 19 feet as measured with an engineering rod.  Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d)

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  On or about February 10, 2023, employees used an extension ladder that did not extend three feet past the point of access of the 2nd level of a new construction dwelling, exposing the employee to falls of more than 6 feet.   Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d)

29 CFR  1926.503(b)(1):The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.  On or about February 10, 2023 the employer failed to certify that employees had been trained to recognize and minimize fall hazards. Employees were exposed to fall hazards in excess of 12 feet while performing roofing activities on a residential structure without using fall protection.   Abatement documentation is required for this item in accordance with CFR 1903.19(d)
