29 CFR 1910.253(b)(2)(ii): Inside of buildings, cylinders shall be stored in a well-protected, well-ventilated, dry location, at least 20 (6.1 m) feet from highly combustible materials such as oil or excelsior. Cylinders should be stored in definitely assigned places away from elevators, stairs, or gangways. Assigned storage spaces shall be located where cylinders will not be knocked over or damaged by passing or falling objects, or subject to tampering by unauthorized persons. Cylinders shall not be kept in unventilated enclosures such as lockers and cupboards. a.) On or about February 10, 2023, the employer did not ensure that the Argon cylinder secured from being struck by or knocked over while located next to the door leading into the breakroom. b). On or about February 10, 2023, the employer did not ensure that the Argon cylinder was secured from being knocked over by employees working at one of the TIG welding stations near the breakroom door.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following: a.) On or about February 10, 2023, the employer did not have a written hazard communication program for employees exposed to hazardous chemicals such as, but not limited to Airgas carbon dioxide (compressed gas, asphyxiant) and Airgas argon (compressed gas, asphyxiant).
