29 CFR  1926.1101(e)(1): All Class I, II and III asbestos work was not conducted within regulated areas which complied with the requirements of 29 CFR 1926.1101(e), paragraphs (2), (3), (4) and (5):  a) Dam Neck Annex, Building 127, Room S128; On or around 2-9-23, and times prior thereto, employees were exposed to asbestos due to removing asbestos positive floor tile and mastic (Class II work) without a regulated area which demarcated the area, restricted access, required respiratory protection in the area, prohibit high risk activities (eating, drinking, smoking ,etc.), and ensure that all asbestos work performed within regulated areas is supervised by a competent person.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR  1926.1101(f)(2)(i):The employer with a work operation covered by the asbestos standard did not ensure that a "competent person" conducted an exposure assessment immediately before or at the initiation of the operation to ascertain expected exposures during that operation or workplace:  a) Dam Neck Annex, Building 127, Room S128; On or around 2-9-23, and times prior thereto, employees were exposed to asbestos due to removing asbestos positive floor tile and mastic (Class II work) without the exposure assessment from a competent person.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
