On February 16, 2023 in the main drumstick fabrication room room at Vater Percussion Inc. 270 Centre Street Unit D, Holbrook, MA 02343 employees were exposed to explosion hazards where surfaces were not effectively cleaned causing a accumulation of combustible wood dust greater than 1/32 in. on surfaces that made up 10.9% of the total effective area.

29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: A) On or about February 16, 2023, in the fabrication room at Vater Percussion Inc. at 270 Centre St UNIT D, Holbrook, MA 02343, an employee was exposed to an 8-hour time weighted average noise level of 97.3 dBA (equivalently a dose of 275.6 %) in excess of the 85 dBA (equivalently a dose of 50%) while operating the drum stick sanding machine where a hearing conservation program had not been implemented. B) On or about February 16, 2023, in the fabrication room at Vater Percussion Inc. at 270 Centre St UNIT D, Holbrook, MA 02343, an employee was exposed to an 8-hour time weighted average noise level of 93.8 dBA (equivalently a dose of 169.0 %) in excess of the 85 dBA (equivalently a dose of 50%) while operating the drum stick sanding machine where a hearing conservation program had not been implemented. C) On or about February 16, 2023, in the fabrication room at Vater Percussion Inc. at 270 Centre St UNIT D, Holbrook, MA 02343, an employee was exposed to an 8-hour time weighted average noise level of 92.5 dBA (equivalently a dose of 140.6 %) in excess of the 85 dBA (equivalently a dose of 50%) while operating Seavey back knife lathes & shaping machines where a hearing conservation program had not been implemented. D) On or about February 16, 2023, in the fabrication room at Vater Percussion Inc. at 270 Centre St UNIT D, Holbrook, MA 02343, an employee was exposed to an 8-hour time weighted average noise level of 90.6 dBA (equivalently a dose of 109.3 %) in excess of the 85 dBA (equivalently a dose of 50%) while operating Seavey back knife lathes where a hearing conservation program had not been implemented. E) On or about February 16, 2023, in the fabrication room at Vater Percussion Inc. at 270 Centre St UNIT D, Holbrook, MA 02343, an employee was exposed to an 8-hour time weighted average noise level of 90.2 dBA (equivalently a dose of 102.6 %) in excess of the 85 dBA (equivalently a dose of 50%) while operating Seavey back knife lathes & shaping machines where a hearing conservation program had not been implemented. The hearing conservation shall include monitoring, offering hearing, baseline & annual audiometric testing, noise training, and posting of standard 29 CFR 1910.95.
