(a) J & M Conveyor, 7905 Interstate 76 Frontage Road, Commerce City, CO 80022; On or about February 14, 2023, and at times prior, the employer exposed employees to combustible chemicals when they allowed spray finishing with combustible materials, such as toluene and Anchor Industrial LoVOC Industrial Enamel, in a spray room with floors constructed of dirt. The employer did not provide a spray room, including floors, that was constructed of masonry, concrete, or other noncombustible material as required in 1910.94(c)(4)(i).

29 CFR 1910.94(c)(6)(i): The velocity of air into all openings of a spray booth was less than that specified in Table G-10 for the operating conditions specified: (a) J & M Conveyor, 7905 Interstate 76 Frontage Road, Commerce City, CO 80022; On or about February 14, 2023, and at times prior, the employer exposed employees to respiratory hazards when only two exhaust fans running at 3200 CFM for a 43,956 ft2 building were used as ventilation for the spray finishing room where employees spray toluene and Anchor Industrial LoVOC Industrial Enamel. Spray rooms were not adequately ventilated so that the atmosphere in the breathing zone of the operator was maintained in accordance with the requirements of paragraph (c)(6)(ii) of this section of 1910.94(c)(4).

The quantity of liquid stored was 265 gallons.

29 CFR 1910.134(c)(1):A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: (a) J & M Conveyor, 7905 Interstate 76 Frontage Road, Commerce City, CO 80022 : On or about February 14, 2023, and at times prior, employees were exposed to primary metals through welding fumes and chemical vapors from paint spraying at unknown levels while performing their daily work duties. The employer required respirators but did not implement a written respiratory protection program describing necessary elements of respiratory protection. (b) J & M Conveyor, 7905 Interstate 76 Frontage Road, Commerce City, CO 80022 : On or about February 14, 2023, and at times prior, employees were exposed to primary metals through welding fumes and chemical vapors from paint spraying at unknown levels while performing their daily work duties. The employer did not provide medical evaluations to employees required to use the respirators as required in 1910.134(c)(1)(ii). (c) J & M Conveyor, 7905 Interstate 76 Frontage Road, Commerce City, CO 80022 : On or about February 14, 2023, and at times prior, employees were exposed to primary metals through welding fumes and chemical vapors from paint spraying at unknown levels while performing their daily work duties. The employer did not provide fit testing procedures for tight-fitting respirators to employees required to use the respirators as required in 1910.134(c)(1)(iii). (d) J & M Conveyor, 7905 Interstate 76 Frontage Road, Commerce City, CO 80022: On or about February 14, 2023, and at times prior, employees were exposed to primary metals through welding fumes and chemical vapors from paint spraying at unknown levels while performing their daily work duties. The employer did not provide procedures for cleaning, disinfecting, storing, inspecting, repairing, discarding, and otherwise maintaining respirators of employees required to use the respirators as required in 1910.134(c)(1)(v). (e) J & M Conveyor, 7905 Interstate 76 Frontage Road, Commerce City, CO 80022: On or about February 14, 2023, and at times prior, employees were exposed to primary metals through welding fumes and chemical vapors from paint spraying at unknown levels while performing their daily work duties. The employer did not provide training of employees in the respiratory hazards to which they are potentially exposed during routine and emergency situations for employees required to use the respirators as required in 1910.134(c)(1)(vii). (f) J & M Conveyor, 7905 Interstate 76 Frontage Road, Commerce City, CO 80022 : On or about February 14, 2023, and at times prior, employees were exposed to primary metals through welding fumes and chemical vapors from paint spraying at unknown levels while performing their daily work duties. The employer did not establish work-site specific procedures to regularly evaluate the effectiveness of the program as required in 1910.134(c)(1)(ix).
