OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to: crushed by hazards while working beneath or adjacent to automotive lifts that were not properly inspected or maintained. a) Precision Tune Auto Care; Automotive maintenance bay 1: On February 14, 2023, and at times prior, the employer exposed employees to crush-by hazards in that employees were required to operate the 2-post Accu Turn automotive lift, model number AC1776A. b) Precision Tune Auto Care; Automotive maintenance bay 2: On February 14, 2023, and at times prior, the employer exposed employees to crush-by hazards in that employees were required to operate the 2-post Bendpak automotive lift, model number XPR-10A.

29 CFR 1910.28(b)(8): Where there were repair pits, service pits, and assembly pits less than 10 feet in depth, the employer did not limit access within 6 feet (1.8 m) of the edge of the pit to authorized employees trained in accordance with � 1910.30; place floor markings at least 6 feet (1.8 m) from the edge of the pit in colors that contrast with the surrounding area; or provide a warning line at least 6 feet (1.8 m) from the edge of the pit with stanchions capable of resisting, without tipping over, a force of at least 16 pounds (71 N) applied horizontally against the stanchion at a height of 30 inches (76 cm); or provide a combination of floor markings and warning lines at least 6 feet (1.8 m) from the edge of the pit. a) At 35 East Nine Mile Rd, Pensacola, FL: On February 14, 2023, and at times prior, the employer allowed employees to perform automotive maintenance activities and restocking activities at or near three open holes in the floor at the pit area of the shop exposing employees to fall hazards of up to 6 feet 1 inch to the ground below.
