OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to serious crushing type injuries associated with operation of the underhung crane/hoist that had a damaged safety latch on the hook.  a. On or about February 13, 2023, and at times prior, in the Loading Dock Area on the 10 metric ton underhung crane/hoist, there was not a functional safety latch mechanism in place on the hook to close the hook's throat and secure loads when employees operated the crane/hoist to lift steel coils, steel I-beams, and other finished and unfinished steel materials weighing up to approximately 8,410 pounds. Employees were thereby exposed to crushing injuries and death associated with being struck-by a fallen load while they operated the crane/hoist with the damaged safety latch.

29 CFR 1910.178(l)(4)(i): Refresher training, including an evaluation of the effectiveness of that training, shall be conducted as required by paragraph (l)(4)(ii) to ensure that the operator has the knowledge and skills needed to operate the powered industrial truck safely.  29 CFR 1910.178(l)(4)(ii): Refresher training in relevant topics shall be provided to the operator when:  29 CFR 1910.178(l)(4)(ii)(A): The operator has been observed to operate the vehicle in an unsafe manner;  a. On or about February 14, 2023, the employer identified an employee operating a Toyota forklift in an unsafe manner and without a seatbelt in the Beam Roll-Forming Area to move pallets of I-beams. The employer did not re-train the employee, thereby exposing employees to struck-by and crushing hazards.

29 CFR 1910.184(d): Inspections. Each day before being used, the sling and all fastenings and attachments shall be inspected for damage or defects by a competent person designated by the employer. Additional inspections shall be performed during sling use, where service conditions warrant. Damaged or defective slings shall be immediately removed from service.  a. On or about January 14, 2023, pre-use inspections were not performed on slings, such as alloy steel chain slings, in use. Employees used an alloy steel chain sling to move steel I-beam materials in the Receiving Area that was missing an identification tag. The sling was not removed from service, thereby exposing employees to struck-by hazard from falling loads.

On or about January 14, 2023, and at times prior, an alloy steel chain sling that was missing an identification tag was utilized on the underhung crane in the Receiving Area to move steel I-beam materials during the staging and unloading processes. Employees were thereby exposed to struck-by hazard from falling loads.

29 CFR 1910.303(b)(7)(i): Unused openings in boxes, raceways, auxiliary gutters, cabinets, equipment cases, or housings shall be effectively closed to afford protection substantially equivalent to the wall of the equipment.  a. On or about February 13, 2023, and at times prior, there was an unused opening in the side of the 100 Amp, 600 Volt AC/DC underhung crane disconnect heavy duty safety switch box in the Receiving Area that was not effectively closed. Employees operated the disconnect switch to turn the crane off and on before and after use and were thereby exposed to contact with electrical hazards.
