29 CFR  1926.652(g)(2):Excavation of material to a level no greater than 2 feet (.61m) below the bottom of a shield system was allowed when there were indications while the trench was open of a possible loss of soil from behind or below the bottom of the shield.  On or about February 14, 2023, the employer Taylor Excavating Inc., permitted its employees to enter the trench and perform work without ensuring that the shielding system was no more than two (2) feet above the bottom of the trench. Two employees were working at the bottom of a 15 feet deep trench inside of a multi-piece stackable trench shield box with 5 feet and 2 tenths of unshielded soil from the bottom of the box to the trench base, exposing them to potential struck-by hazards in the event of cave-in below the bottom of the trench box.
