29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets. a) On or about February 14, 2023, at 2901 Hummingbird Road in Wausau, Wisconsin, employees who were not wearing hard hats were exposed to potential struck-by hazards while working below a sidewall roof eave with a wet/dry vacuum and shovel on the roof. b) On or about February 14, 2023, at 2901 Hummingbird Road in Wausau, Wisconsin, employees who were not wearing hard hats were exposed to potential struck-by hazards while walking and/or working below a gable roof eave with a portable generator and debris bags on the roof. c) On or about February 14, 2023, at 2901 Hummingbird Road in Wausau, Wisconsin, employees who were not wearing hard hats were exposed to potential struck-by hazards while using a roof access/egress ladder below an eave with hand tools, shovels, and a debris bundle on the roof.

29 CFR 1926.501(b)(10): "Roofing work on Low-slope roofs." Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone [i.e. without the warning line system] is permitted. a) On or about February 14, 2023, at 2901 Hummingbird Road in Wausau, Wisconsin, employees were exposed to fall hazards while engaged in commercial roofing work on a roof surface 9.5 feet above surface level without using fall protection equipment. b) On or about February 14, 2023, at 2901 Hummingbird Road in Wausau, Wisconsin, employees were exposed to a fall hazard while engaged in commercial roofing work on a roof surface 18 feet above surface level without using fall protection equipment.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. On or about February 14, 2023, at 2901 Hummingbird Road in Wausau, Wisconsin, the employer did not provide required fall protection safety training for employees working at heights greater than six feet. Employees were installing roofing materials on one-story and two-story roof surfaces with unprotected roof edges.
