OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard when working on an elevated platform on a forklifts without the use of a fall protection: a. 95 Caven Point Road, Jersey City, NJ 07305 - Warehouse The employer failed to ensure that his employee working on an elevated platform on a high-level order picker used fall protection. An employee operated a Crown 3500 Series high-level order picker to pick up orders at the height of approximately 6.7 feet and was not wearing a fall harness and lanyard attached to the equipment. Violation observed February 14, 2023

An employee operated a Doosan Forklift Model GC25S-9 to move pallets of merchandise throughout the warehouse without a seatbelt. Violation observed February 14, 2023

Employees operated equipment that included, but was not limited to, Crown 3500 Series order pickers, Raymond Model 8410 Power Pallet jacks, and Doosan forklifts, for warehousing activities and were not provided an evaluation and certification following an accident and/or observed unsafe operation.
