29 CFR  1926.501(b)(2): Each employee who was constructing a leading edge 6 feet or more above lower levels were not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems:  On or about February 14, 2023, at or near the corner of 32nd Avenue South and Sienna Drive, employees engaged in roof sheathing operations on a commercial building under construction, were exposed to falls of 15 feet without any fall protection.

29 CFR  1926.501(b)(2)(ii): Each employee on a walking/working surface 6 feet (1.8 m) or more above a lower level where leading edges are under construction, but who was not engaged in the leading edge work, was not protected from falling by a guardrail system, safety net system, or personal fall arrest system.  On or about February 14, 2023, at or near the corner of 32nd Avenue South and Sienna Drive, employees who were handling and moving materials on a flat-roofed commercial building under construction were exposed to falls of 15 feet at the leading edges and perimeters.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   On or about February 14, 2023, at or near the corner of 32nd Avenue South and Sienna Drive South, employees were exposed to falls of 14.5 feet while using an extension ladder that did not have the rails extended at least 3 feet. to access the lower-level roof.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  On or about February 14, 2023, and times prior, at or near the location of the corner of 32nd Avenue South and Sienna Drive South, the employees of 218 Construction, LLC, employees engaged in roof sheathing activities and exposed to fall hazards were not provided training in the recognition and avoidance of fall hazards or the proper use of fall protection.
