29 CFR  1910.1025(h)(1) as required by 1960.8(b): All surfaces were not maintained as free as practicable of accumulations of lead:  On or about February 15, 2023, in Building 14 - Suite 007, the employer did not ensure all surfaces such as, but not limited to the copier were maintained as free as practicable of lead surface contamination.  Exposure to lead can lead to health symptoms such as, but not limited to headaches, fatigue and anemia.

29 CFR  1910.134(c)(1) as required by 1960.8(b): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  Veterans Health Administration, Battle Creek VA Medical Center located at 5500 Armstrong Road, Battle Creek, MI 49037:  On or about February 15, 2023 and at times thereafter, the employer did not implement a written respiratory protection program with worksite-specific procedures for respirator use that included all provisions in 29 CFR 1910.134(c)(1)(i) - (ix).  The employer required employees to wear respirators throughout their shifts while exposed to suspected or confirmed positive COVID-19 patients and during outbreaks among staff or patients. The employer had not fully implemented the requirements of medical evaluations and fit testing for all employees required to wear respirators in the workplace.  The Veterans Health Administration was previously cited for a violation of an equivalent occupational safety and health standard 29 CFR 1910.502(f)(2)(i) as required by 1960.8(b), which was contained in OSHA inspection number 1558615, notice number 1, item number 2a and was affirmed as a final order on January 13, 2022, with respect to a workplace located at 5838 Metro Way Southwest in Wyoming, Michigan.

29 CFR  1910.502(q)(2)(ii)(A) as required by 1960.8(b): The COVID-19 log did not contain, the employee's name, one form of contact information, occupation, location where the employee worked, the date of the employee's last day at the workplace, the date of the positive test for, or diagnosis of, COVID-19, and the date the employee first had one or more COVID-19 symptoms, if any were experienced.  Battle Creek VA Medical Center located at 5500 Armstrong Road, Battle Creek, MI 49037:  On or about February 15, 2023 and at times thereafter, the employer failed to ensure the COVID-19 log contained the employees' occupation.
