29 CFR  1910.1030(c)(1)(ii): The Exposure Control Plan shall contain at least the following elements: (A) The exposure determination required by paragraph (c)(2), (B) The schedule and method of implementation for paragraphs (d) Methods of Compliance, (e) HIV and HBV Research Laboratories and Production Facilities, (f) Hepatitis B Vaccination and Post-Exposure Evaluation and Follow-up, (g) Communication of Hazards to Employees, and (h) Recordkeeping, of this standard, and (C) The procedure for the evaluation of circumstances surrounding exposure incidents as required by paragraph (f)(3)(i) of this standard:   a) On or about February 15, 2023, at the facility located at 2401 Fieldcrest Drive, Kaukauna, Wisconsin, the written Exposure Control Plan did not identify the employee groups with occupational exposure to bloodborne pathogens . b) On or about February 15, 2023, at the facility located at 2401 Fieldcrest Drive, Kaukauna, Wisconsin, the written Exposure Control Plan did not include specific information related to the engineering controls and work practices implemented to eliminate or minimize employee exposure to blood or other potentially infectious materials in the Prep Room. c) On or about February 15, 2023, at the facility located at 2401 Fieldcrest Drive, Kaukauna, Wisconsin, the written Exposure Control Plan did not include specific information related to the Personal Protective Equipment to be worn during the embalming process and during the cleaning and decontamination after the embalming procedure is completed. d) On or about February 15, 2023, at the facility located at 2401 Fieldcrest Drive, Kaukauna, Wisconsin, the written Exposure Control Plan did not include a written schedule for cleaning and methods of decontamination of the Prep Room following an embalming procedure. e) On or about February 15, 2023, at the facility located at 2401 Fieldcrest Drive, Kaukauna, Wisconsin, the written Exposure Control Plan did not include specific information for the collection, storage, packaging and disposal of contaminated sharps and other regulated waste. f) On or about February 15, 2023, at the facility located at 2401 Fieldcrest Drive, Kaukauna, Wisconsin, the written Exposure Control Plan did not include specific instructions for the employer and the exposed employee to be completed following the report of an employee exposure incident.

29 CFR  1910.1048(h)(1)(i): All contact of the eyes and skin with liquids containing 1 percent or more formaldehyde shall be prevented by the use of chemical protective clothing made of material impervious to formaldehyde and the use of other personal protective equipment, such as goggles and face shields, as appropriate to the operation:  On or about December 29, 2022, at the facility located at 2401 Fieldcrest Drive, Kaukauna, Wisconsin, an employee performing an embalming procedure in the Prep Room was splashed in the eye by a formaldehyde containing liquid. The employee was not wearing safety glasses, chemical goggles or a face shield.

(Electronic access and other alternatives to maintaining paper copies of the safety data sheets are permitted as long as no barriers to immediate employee access in each workplace are created by such options.):  On or about February 15, 2023, at the facility located at 2401 Fieldcrest Drive, Kaukauna, Wisconsin, the employer had not updated Safety Data Sheets for received products with revised safety data sheets. The current Safety Data Sheets for Dodge Chromatech Tan and Dodge Dis-Spray are six years newer than the safety data sheets being maintained in the employer's MSDS binder.
