29 CFR  1910.178(l)(6):Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation.  On or about February 14, 2023 the employer failed to certify the operator of the JCB 524-50 Loadall was trained on the safe operation.  No certification was provided when requested.

29 CFR  1926.451(c)(2)(iv):Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use.  On or about February 14, 2023, employees working from a job made box were elevated 15 feet in the air by a JCB 524-50 Telescopic lift to perform residential framing and trim activities. The JCB 524050 Telescopic lift was not designed to be used as a personnel lift.  Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR  1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  On or about February 14, 2023 employees were not protected from falls while performing residential framing and trim work at a height in excess of 15 feet.  The employees were in a job built basket that was lifted by a JCB 524-50 Loadall telescoping lift.  The employees were not utilizing any fall protection devices.    Abatement documentation is required for this item in accordance with 29CFR 1903.19(d).

29 CFR  1926.454(a):The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.   On or about February 14, 2023, the employer failed to train employees on how to recognize and minimized fall hazards associated with working on scaffolds.  Employees were performing trim work on a new residential home while standing on a job built basket that was being elevated by a JCB 524-50 Loadall.  The platform was in excess of 15 feet and employees were not utilizing a fall protection system.
