OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a) On or about 2/15/2023 at a construction site located at29 Canalview Terrace, Buffalo, New York; an employee was working on the front of the house near a window using a plywood on the forks of a rough terrain forklift. The use of an unsecured sheet of plywood was not approved for use to lift personnel by the forklift manufacturer, exposing employees to a fall hazards. NO ABATEMENT CERTIFICATION REQUIRED

The employees on the platform did not have a harness with a lanyard attached to the boom or basket while operating the lift. NO ABATEMENT CERTIFICATION REQUIRED
