OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the struck-by or crushing hazards when operating a forklift without the use of a restraint device:  (a) On or about February 15, 2023, and at time prior to, the employer did not enforce the use of a  seatbelt for the employee operating the Toyota side shifter, S/N: 11753 in the yard area.   (b) Inside bay: On or about February 15, 2023, and at time prior to, the employer did not enforce the use of a seatbelt for employee operating the Hyster, model H50CT, S/N: A274V03637M to move equipment, such as but not limited to, the welding machines used for fabrication.
