OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to struck-by and crushing hazards from the collapse of a roof structure under construction.  Location: Bible Hill Rd. in Bennington, NH.  On or about February 10, 2023, the framing techniques in use by the framing crew were not adequate to provide strength to the structure where (1) gable end walls had structural sheathing that was not secured to the framing below, (2) gable wall base plates had not been secured adequately to the framing below, (3) and there was not adequate bracing of the gable end walls to provide structural stability. These conditions contributed to the collapse of the structure, where the framing and bracing practices of the employer did not provide adequate structural strength to withstand environmental elements such as wind pressure at the time of collapse. Two employees suffered serious injuries and a third suffered minor injuries when the roof structure collapsed and struck all three, knocking one off the structure 19 feet to the ground below.

29 CFR  1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s).  Bible Hill Rd. Jobsite - On or about February 10, 2023, the employer did not perform frequent and regular inspections of the jobsite to ensure that it was free from recognizable hazards where employees were exposed to falls through window openings and floor holes, electrical shock hazards from damaged extension cords, and struck-by hazards from the partial collapse of the structure during a high wind event at the jobsite.

29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury.  Bible Hill Rd. Jobsite - On or about February 10, 2023, the employer did not provide training to employees in recognizing and avoiding unsafe conditions where employees were exposed to electrical shock hazards and falls through window openings and floor holes.   Additionally, of significance, employees were not trained to recognize and avoid the unsafe conditions associated with performing their job tasks during a high wind weather event, where exposure to struck-by hazards could occur during the collapse of the structure.

Safety of equipment was not determined on the basis of the following considerations:  Electrical insulation.  Bible Hill Rd. Jobsite - On or about February 10, 2023, the employer did not ensure that electrical equipment was free from recognized hazards that were likely to cause death or serious physical harm to employees, where two electrical cords in use at the site were not inspected prior to being placed into service and were being used with damaged outer insulation which exposed internal insulated conductors.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   Location: Jobsite on Bible Hill Rd.   Instance a.) On or about February 10, 2023, employees framing a residential home were not protected from falls of between 7 and 11 feet where the window openings at the back of the first floor did not have guardrails installed on them to prevent an employee from falling out.  Instance b.) On or about February 10, 2023, employees framing a residential home were not protected from falls of approximately 9 feet from the attic deck to the first floor where the attic deck was not fully sheathed. A large portion of the attic deck was open, where employees could have fallen through the floor joists down to the first floor.
