29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). If such hazards are present, or likely to be present, the employer shall: (i) Select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment; (ii) Communicate selection decisions to each affected employee; and (iii) Select PPE that properly fits each affected employee. On or about February 10, 2023, and at times prior thereto, the employer did not ensure that affected employees were using personal protective equipment (PPE) that was identified in the hazard assessment for Sump operations, exposing the employees to struck-by hazards.

29 CFR 1910.146(c)(5)(ii)(B): When entrance covers are removed, the opening shall be promptly guarded by a railing, temporary cover, or other temporary barrier that will prevent an accidental fall through the opening and that will protect each employee working in the space from foreign objects entering the space. On or about February 10, 2023, and at times prior thereto, an uncovered sump entrance was not properly barricaded to prevent accidental fall through the opening and to prevent foreign objects from entering the space while employees are working, exposing employees to struck-by hazards.

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours. On February 10, 2023, at approximately 11:25am, an employee suffered an injury that resulted in an in-patient hospitalization. The hospitalization was not reported within 24 hours to the local Area Offices of the Occupational Safety and Health Administration.
