OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to workplace violence in the form of repeated and consistent exposure to violent physical attacks from Clients Supported which resulted in serious injuries: a)LifeScape, Inc. at 2501 West 26th Street, Sioux Falls, SD 57105: On or about February 16, 2023 and at times prior to and thereafter, employees were exposed to incidents of workplace violence when Clients Supported displayed aggressive behavior resulting in bites, headbutts, kicks, hair pulls, pinching, and being struck with objects. Incidents of workplace violence occurred primarily in the Children's Specialty School and the Inter Care Facility (ICF).

29 CFR 1910.132(a): Protective equipment was not used and maintained in a sanitary and reliable condition: (a)LifeScape, Inc. at 2501 West 26th Street, Sioux Falls, SD 57105: On or about February 16, 2023 and at times prior to and thereafter, employees working in the Inter Care Facility (ICF) were exposed to biological hazards while using arm guards, blocker pads and mats, wrestling helmets, and other Personal Protective Equipment (PPE) contaminated with bodily fluids such as but not limited to blood, feces, urine, or saliva.
