29 CFR  1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  a) On and before February17, 2023, employees were not provided an energy control program and the associated training to insure employees preforming servicing and maintenance, and those employees affected by such activities were given the materials and knowledge required to identify,  avoid, and control the hazardous energy associated with the machines, equipment and other powered devices and electrical systems used in this facility.

29 CFR  1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:  (a) On or about February 17, 2023, in the automotive repair bays and at the battery charging station: Employees are exposed to Sulfuric  acid and other corrosives while servicing batteries, were not provided adequate drenching and flushing facilities for immediate emergency flushing of the eyes and body.

29 CFR  1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer did not establish and implement a written respiratory protection program with worksite-specific procedures.  (a) On or about February 17, 2023, and dates prior, the employer, National Complete Auto Care did not establish and implement a written respiratory protection program. Employees were required to use respirators while performing spraying operations in the automotive refinishing department.

29 CFR  1910.134(f)(1):The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT):  (a) On or about February 17, 2023, the employer, National Complete Auto Care did not ensure employees using a tight-fitting facepiece respirator were fit tested prior to initial use, whenever a different respirator is used, and at least annually.  Proper fitting of respirators is crucial in order for respirators to work as they are designed to.

29 CFR  1910.1200(e)(1):The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met.  a) On or about February 17, 2023, National Complete Auto care  had not developed a written hazard communication program that identified the potential hazards employees were exposed to while using hazardous chemicals such as but not limited to, oils and lubricants, hydraulic and transmission fluids,  fuels and cleaners, automotive  finishes,  Premium Paint and Epoxy remover, reducers, solvents, acids, charging gasses and other  associated chemicals.

Specific Safety Data Sheets (SDS) not maintained in the workplace were, but not limited to paints, oils, lubricants, hydraulic and transmission fluids and solvents.
