29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) On or about and at time prior to February 21, 2023, at the job-site located at 9605 Gulf Drive Anna Maria, Florida. Employees were exposed to fall hazards of approximately 9 feet 7 inches while framing a residential structure, in that, fall protection was not used.  b) On or about and at time prior to February 21, 2023, at the job-site located at 9605 Gulf Drive Anna Maria, Florida. Employees were exposed to fall hazards of approximately 20 feet 5 inches while framing a residential structure, in that, fall protection was not used.

29 CFR  1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.  a) On or about February 21, 2023, at the job-site located at 9605 Gulf Drive Anna Maria, Florida. Employees who were doing frame work on the second floor were exposed to fall hazards of approximately 9 feet 7 inches due to wall and window openings which were not guarded.

29 CFR  1926.1053(b)(5)(i): Non-self-supporting ladder(s) were not used at an angle such that the horizontal distance from the top support to the foot of the ladder was approximately one-quarter of the working length of the ladder.  a) On or about February 21, 2023, at the job-site located at 9605 Gulf Drive Anna Maria, Florida. The 20-ft. Werner aluminum extension ladder used to access the second level of the structure, was use at an angle that the horizontal distance from the top support to the foot of the ladder (approximately 9-feet and 6 inches) was more than one quarter of the working length of the ladder (4-feet approximately), exposing employees to a fall hazard.
